OFW Deployment Ban in Saudi Arabia

The Philippines Department of Labor and Employment may expand the deployment ban to Saudi Arabia due to the common practice of Saudi Employers to Illegal Transfer or "Trade" of Filipino Domestic Workers to other employers that resulted to unreported cases of maltreatments and abuses.

The Philippine Labor Secretary said that trading and switching of foreign household workers known as "Kafala" is a common practice in Saudi Arabia where in the Kingdom about more than 1.2 Million Filipinos are working. He said that the Philippine would impose the same deployment restrictions it applied to Kuwait if Saudi Arabia does not strengthen its protection of Filipino workers.

Under the "Kafala" or Sponsorship system, the Saudi Citizen employer or sponsor has the complete control over the mobility of the migrant worker. A foreign worker for instance, cannot quit work or transfer jobs without first obtaining the consent of his employer, which practically places the worker at the mercy of his employer.

Kingdom of Saudi Arabia is the biggest employer of Filipino workers, who make up the fourth largest group of foreigners and who are the second largest source of remittances to the Philippines.

As part of the Philippine Government move to improve protection for Filipino Workers, the Department of Labor of the Philippines sent a team to the Middle East to assess conditions and provide immediate assistance and recommend actions to deal with the situation.

As per the Department of Labor Secretary of the Philippines, the report from the assistance team sent in Middle East will be a reliable basis for the amendment or enhancement of existing bilateral labor agreements with Arab countries to provide better protection for Filipino Workers. He said, if there is an existing bilateral labor agreement but there are still rampant cases of maltreatment, then maybe we need to amend the agreement.

The Philippine President's minimum demand is only to deploy  countries where Filipino Workers are properly and effectively protected.

Job Fair in the Middle East for the Filipino Engineers

It's time to put a stop to brain drain. It's a good news for Filipino's working in the Middle East especially for Engineers and Professionals who faces difficulties in the present crisis and who has issues in their salary and sponsorship. If there is a chance to go back to Philippines and get a job with a fair salary then this is the time to decide.

Secretary Ernesto Pernia of the National Economic and Development Authority said the government wants more engineers back home and rendering their services for the local infrastructure boom under the Duterte administration.

Pernia said the Labor department will be staging a job fair in the Middle East to the Filipino Engineers and experts to return to the Philippines, with the promise of a competitive pay.

"We will make sure that the salary differential between what they are getting in overseas workplaces and here will be minimal or maybe even more than whatever they are getting," Pernia said in a speech on Thursday, Feb. 22.

We hope this will encourage Filipino Professionals to return home.

Saudi Arabia: 7 Things to Consider Before Reporting Your Employer to Labor Department

Employees are free to raise complaints against their employers in Saudi Arabia. Disputes are taken to labor offices, found all over Saudi Arabia, where the court listens to both sides of the party, examine evidence and decide on the judgment. Appeals to the court are also rare; oftentimes both parties accept the judgment as it is given. Though the process is good for both sides, the process is tedious and complicated, not to mention takes effort and time so be sure that you are in the right mind to file a case against your employer and not just spurned by emotions in that moment .

Number One: Always think of court as a last resort : Is it just a disagreement? Do you think you and your employer could settle it yourselves? You could settle for an agreement, perhaps some sort of compensation. Though it may not be legal, it is on some sort binding as well as easier to do. Just be sure to emphasize on what you want (or what you don't want, in any case of unwanted attention) from your employer.

Number Two: Know your rights:It is very important to know you rights so you know what you can ask and what you can claim. Sometimes you might feel abused but it is just the difficulty of the job and not true abuse of your employer.

Number Three: Time and effort: It takes a minimum of 2-3 months for a case to be resolved, and that is only if you're lucky and your employer responds immediately. It could take up to a year or more depending on the complications of the case and the willingness of your employer.

Number Four:  Money: Cost of living in Saudi may be reasonable but not if you are jobless. By filing a case, you earned yourself some time off where you will not earn money. Before making a case, make sure you have enough cash to tide over the case as well as keep yourself fed and sheltered. You can ask the labor office for a temporary permit to work but you can only do laborious daily wage jobs with these.

Number Five: Huroob Status: Your employer has the authority to set huroob under your Iqama even with your pending case in the labor office. With this, police may come and detain you in Saudi Detention Centers until the decision was made by the labor office.

Number Six: Termination: Your employer would be most displeased when you file a case against them which could lead to immediate termination. It is strongly recommended though that you stay on the job until given written notice of termination from your employer as leaving before getting this letter could weaken your case.

Number Seven: Arabic Language: Though not really a hindrance, it may prove to give an advantage when you are proficient in written and spoken Arabic. Government officers use Arabic in their communications and while you can still file a complaint, you might want to ask someone who speaks and writes Arabic to help you. Later on, the court will arrange for a translator for you.
